The New Flood and Water Management Act

The new Flood and Water Management Act received Royal Assent on the 8th April 2010 and aims to make improvements to both flood risk management and the way we manage water resources.

The Act clarifies roles and responsibilities with relation to reducing the likelihood and impact of flooding. Local authorities are given responsibility for managing local surface water flooding. The Environment Agency is given overall responsibility for flooding in England (with the devolved Parliaments are responsible for their own flooding strategy).

House builders and developers will be required to incorporate sustainable drainage systems into new developments. Additional rules are enforced regarding the content of a flood risk assessment. All developers should therefore understand these new regulations and the additional legal frameworks they bring into effect, which is anticipated to be in Spring 2011.
